In Australia, the Courts must consider what’s in “the best interests of the children” when deciding what type of parenting orders to make. There are a range of factors that the Court usually considered when deciding what’s in the children’s best interest. Some of these factors include, for example:

  • the nature of a child’s relationship with each parent;
  • the maturity of the child;
  • the quality of communications between the parents;
  • the level of involvement each parent has had with a child; and
  • any family violence involving the child or either parent.
